1. Clutch5 Is a Sports Alert and Discovery Service

Clutch5 helps users discover live games or matches that may be worth turning on before they end. Clutch5 detects situations such as close scores, late-game conditions, overtime, deciding sets, or comebacks, and may send a notification or display a recommendation.

Clutch5 does recommend games to watch. Suggesting that a particular game is worth turning on right now is the product. Those suggestions are editorial and entertainment recommendations about what to watch, based on automated detection that can be wrong or late.

Clutch5 does not recommend, and does not intend any of its content as a recommendation about, any bet, wager, trade, event contract, investment, deposit, or other financial transaction. A game appearing in Clutch5, being highlighted, or triggering an alert is not a signal about any market, price, probability, or outcome.

Clutch5 is not an official scoring service, league authority, broadcaster, sportsbook, prediction market, trading venue, broker, or financial adviser.

2. Sports Scores and Game State May Be Inaccurate or Delayed

Sports data comes from third-party data providers and external systems and can be delayed, incomplete, unavailable, incorrectly mapped, or wrong. This includes scores; game clocks and time remaining; inning, period, quarter, half, set, game, or match status; possession or serve; overtime or extra-time status; start times; final status; lineups; broadcast or streaming availability; and whether a game actually meets Clutch5’s alert criteria.

CLUTCH5 DOES NOT GUARANTEE THE ACCURACY, COMPLETENESS, TIMELINESS, OR REAL-TIME NATURE OF SPORTS INFORMATION. Clutch5 does not use official league data unless expressly stated.

If a score, clock, or status matters to you, confirm it with an official league, event, team, broadcaster, or other authoritative source.

3. Alerts Are Not Guaranteed

Clutch5’s purpose is to alert users early enough to watch exciting finishes, but Clutch5 does not guarantee that it will succeed for any particular game or match.

An alert can arrive too early, too late, after a game is over, or more than once; can contain stale or incorrect information; can point to the wrong destination; can fail because a data provider, Clutch5, a device, browser, push service, operating system, network, or notification setting prevented it; or may not be generated at all. A game may also stop being close immediately after an alert is sent.

Clutch5 is not responsible for a missed finish, missed broadcast, missed opportunity, or any other consequence of a late, failed, duplicate, or inaccurate notification.

4. Streaming and Watch Links May Be Wrong or Unavailable

Clutch5 may link to an official broadcaster, league, streaming service, website, or app. Clutch5 does not provide, host, embed, or frame the stream and does not guarantee it.

A watch link may open the wrong event or landing page; fail to deep-link into an installed app; require a separate subscription or authentication; be subject to blackout or geographic restrictions; be unavailable on your device; change without notice; or stop working because the third party changed its service. Broadcast and streaming rights change frequently.

Verify viewing availability directly with the broadcaster or streaming provider.

A Clutch5 subscription does not include, and does not pay for, any third-party stream or streaming subscription. See the Subscription & Cancellation Terms for how interruptions and third-party outages are handled for billing purposes.

5. Clutch5 Is Not a Betting, Gambling, or Trading Service

Clutch5 does not accept bets or wagers, operate a sportsbook, casino, betting exchange, or prediction market, accept deposits, place bets or execute event-contract orders on your behalf, hold trading or betting funds, or determine or settle bets, wagers, or event contracts.

Clutch5 may display informational market prices, implied probabilities, or event-contract information and may link to independent third-party prediction-market or event-contract services (for example, Kalshi or Polymarket). Those features do not make Clutch5 a gambling, brokerage, exchange, or trading service.

Clutch5 may hide, restrict, or geographically limit market information and third-party market links at any time, including in response to legal or regulatory developments, and may use your approximate location to do so.

6. Third-Party Market Services Are Independent

Any prediction-market or event-contract service linked from Clutch5 is independent from Clutch5. Unless expressly disclosed in writing, Clutch5 does not control those services; does not determine their markets or settlement rules; does not guarantee their legality or availability in your location; does not determine your eligibility; does not execute or settle transactions on them; and a link does not imply endorsement, partnership, approval, sponsorship, affiliation, or any inducement to transact.

Your relationship with a third-party market is governed by that service’s own rules, terms, privacy policy, fees, eligibility requirements, and applicable law.

If Clutch5 has a paid sponsorship, referral, or affiliate relationship with a linked service, we will disclose it clearly at or near the link.

7. Market Prices and Probabilities May Be Delayed or Non-Executable

Any market price, implied probability, event-contract price, or related information shown by Clutch5 may be delayed, cached, transformed, rounded, unavailable, or out of date, and may differ materially from the price actually available when you reach a third-party platform.

A Clutch5 display is not a quote, executable price, offer, bid, ask, guarantee, or promise that a transaction is available. Third-party market rules may define outcomes differently than you expect; review the official contract or market rules on the third-party platform before acting.

8. No Financial, Investment, Legal, Tax, or Gambling Advice

Nothing on Clutch5 is financial, investment, legal, tax, gambling, or trading advice. Clutch5 does not recommend whether you should bet, wager, buy or sell an event contract, trade, invest, open an account, deposit or withdraw funds, or take any other financial action. Any decision you make is your own.

9. Eligibility, Location, and Applicable Law

Prediction markets, wagering, trading, and related activities are regulated differently across jurisdictions, and the legal treatment of sports event contracts is the subject of ongoing litigation and regulatory action in the United States.

Third-party services may impose age, identity-verification, residency, geographic, sanctions, financial, or other requirements, and may be unavailable in your state.

Market information displayed on Clutch5 is not intended for use where displaying it or accessing the linked activity would violate applicable law. Clutch5 may suppress market information or links based on legal, regulatory, contractual, or geographic considerations. You remain responsible for determining whether you may lawfully access or use a third-party service and whether you satisfy that service’s requirements. The visibility of a link on Clutch5 is not a determination that a third-party service is permitted for you.

10. Do Not Use Clutch5 Data to Settle Bets, Trades, Contests, or Financial Obligations

Clutch5 data is for sports discovery and general information only. Do not use Clutch5 scores, clocks, alerts, market values, probabilities, or statuses as the basis for settling a wager or event contract; resolving a fantasy or contest payout; calculating a financial obligation; making a compliance determination; or resolving a dispute over an official result. The applicable official league, competition, market, contract, or other authoritative rules control.

11. Third-Party Names and Trademarks; No Affiliation

Clutch5 refers to leagues, teams, athletes, tournaments, broadcasters, streaming services, and market services by name solely to identify the event, the participants, and where the event may be watched or followed. Clutch5 does not use league, team, or broadcaster logos or official marks without permission.

Third-party names and marks belong to their respective owners. Unless expressly stated, Clutch5 is not sponsored, endorsed, certified, approved by, or affiliated with any league, team, athlete, broadcaster, streaming service, or market service.

12. Risk and Help

Third-party wagering, prediction-market, and event-contract activity involves real financial risk, including the risk of losing money. Clutch5 does not encourage, promote, or discourage that activity, and takes no position on whether you should participate.

13. Assumption of Risk

Real-time sports information, push notifications, streaming availability, and third-party market data depend on systems outside Clutch5’s control. You assume the risks of relying on time-sensitive information and of choosing to visit or use any third-party service.

14. Limitation of Liability

To the maximum extent permitted by law, FlipCard LLC and Clutch5 are not liable for losses or damages arising from incorrect or delayed sports or market data; late, failed, duplicate, or missing alerts; missed viewing opportunities; unavailable streams or subscription requirements; third-party account restrictions; wagering, trading, investment, or financial losses; decisions made on any third-party service; or a third party’s acts, omissions, outages, rules, security, or conduct.

The disclaimers and liability limitations in the Clutch5 Terms of Service, including the aggregate liability cap, also apply.

These limitations apply only to the maximum extent permitted by law. They do not exclude or limit any liability that cannot lawfully be excluded or limited, and nothing in this Disclaimer is intended to give Clutch5 complete immunity or to waive any right you have that cannot be waived under applicable law. Some jurisdictions do not allow certain exclusions or limitations, so some of them may not apply to you.

15. Scope of This Disclaimer

This Disclaimer describes limits on what Clutch5 promises. It does not do any of the following:

• it does not grant, establish, confirm, or evidence any right, licence, or permission for Clutch5 to collect, display, cache, redistribute, or send sports data, market data, broadcast information, or third-party content. Those rights, if any, come only from the applicable provider agreements and applicable law;
• it does not override how Clutch5 actually behaves. If Clutch5 markets, promotes, presents, or recommends something in a way that conflicts with this Disclaimer, the actual conduct is what counts, and this Disclaimer is not a defence to it; and
• it does not determine your eligibility for, or the legality of, any third-party service.
